Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website and the body-composition analysis and recomposition services (the “Services”) provided by KEPT Lab Inc. (“KEPT Lab”, “we”, “our”, or “us”). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

KEPT Lab provides educational and informational content and tools relating to fitness, nutrition, and body composition. We are not a medical provider, and the Services are not medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before starting any diet, exercise, or recomposition program, especially if you are pregnant, nursing, under 18, or have any medical condition. Never disregard professional medical advice because of something you read or receive through the Services.

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract to use the Services. By using the Services, you represent that you meet these requirements.

You are responsible for the accuracy of the information you provide and for keeping your account credentials confidential. You are responsible for all activity under your account. Notify us promptly of any unauthorised use at hello@keptlab.com.

The Services may include a body-composition analysis, biometric scores, before-and-after visualisations of potential outcomes, a personalised recomposition protocol, and access to our care team. Visualisations and projections are illustrative estimates generated from the information you provide and may be digitally generated; they are not promises of results.

Individual results vary and depend on many factors outside our control, including your starting point, consistency, genetics, and adherence. We do not warrant that you will achieve any particular outcome.

• Fees are described at the point of purchase. By subscribing, you authorise us (through our payment processor) to charge the applicable fees.
• Subscriptions renew automatically until cancelled. You may cancel at any time, effective at the end of the current billing period.
• Except where required by law, fees already paid are non-refundable. Any refund or trial terms offered at purchase will control.

You agree not to misuse the Services, including by: violating any law; infringing others’ rights; uploading content you do not have the right to share; uploading images of anyone without their consent; attempting to reverse engineer, scrape, or disrupt the Services; or using the Services to build a competing product.

You retain ownership of the information and images you submit (“User Content”). You grant KEPT Lab a limited, worldwide, non-exclusive licence to host and process your User Content solely to provide and improve the Services, as described in our Privacy Policy. You represent that you have the rights to submit your User Content.

The Services, including all software, text, designs, models, scores, and branding, are owned by KEPT Lab or its licensors and are protected by intellectual-property laws. We grant you a limited, non-transferable, revocable licence to use the Services for your personal, non-commercial use. All rights not expressly granted are reserved.

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

To the fullest extent permitted by law, KEPT Lab and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Services. Our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 100.

You agree to indemnify and hold KEPT Lab harmless from any claims, damages, and expenses (including reasonable legal fees) arising from your use of the Services, your User Content, or your violation of these Terms.

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Services or other users. Provisions that by their nature should survive termination will survive.

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state or federal courts located in Delaware, unless applicable law provides otherwise.

We may update these Terms from time to time. We will post the revised version with a new “Last update” date, and your continued use of the Services after changes take effect constitutes acceptance.
